H1B Visa Application Checklist:

  1. Eligibility: Confirm that the applicant and the job position meet the H1B visa requirements.
  2. Employer’s Role: Ensure that the employer is willing and able to sponsor the H1B visa.
  3. Labor Condition Application (LCA): File the LCA with the Department of Labor (DOL) and ensure compliance with the regulations.
  4. H1B Petition: Complete and submit Form I-129, Petition for Nonimmigrant Worker, to the US Citizenship and Immigration Services (USCIS).
  5. Supporting Documents: Gather and submit all required documents, such as:
    • Proof of the beneficiary’s education and experience
    • Job offer letter detailing the job duties, qualifications, and work location
    • Proof of the employer-employee relationship
    • Detailed description of the offered wage and working conditions
    • Evidence of the employer’s ability to pay the proffered wage
  6. Fees: Pay the required fees, including the:
  7. Premium Processing (Optional): Submit Form I-907, Request for Premium Processing Service, for faster processing.
  8. Additional Requirements for Dependents (if applicable): Prepare and submit H-4 visa applications for the applicant’s spouse and/or children.
  9. Response to Request for Evidence (RFE): Provide a timely and complete response if the USCIS requests additional evidence or clarification.
  10. Visa Stamping and Entry: After the approval of the H1B petition, apply for a visa stamp at a U.S. consulate and schedule an appointment for entry into the U.S.
